Is there a difference between a public defender and a lawyer?

Nope, there is no difference! Public defenders are lawyers - they are appointed by a judge to represent people who are charged with criminal offenses and can’t afford to hire a lawyer. Public defenders have graduated from law school, passed the bar exam, and maintain all North Carolina accreditations to practice law.

How do I find out if I’m eligible to have my criminal record expunged?

There are a couple of different options to get help finding out if you are eligible for an expunction. Expunction law is complicated, but this online guide is a helpful start to understanding whether or not you can file for an expunction under North Carolina law. The great news is that all dismissed charges are now eligible for expunction in North Carolina!

If you’re looking for help with the expunction process, ask your attorney for info on the free expunction clinics our office helps coordinate. The Self-Serve Center on the third floor of the Mecklenburg County Courthouse can also guide you through the filing process. Additionally, Charlotte Center for Legal Advocacy holds regular expunction clinics - you can sign up by calling 704-971-2609.
